Biodiversity Net Gain launch date confirmed as 12 February 2024

The Department for Environment, Food & Rural Affairs (Defra) have confirmed that Biodiversity Net Gain (BNG) will be mandatory for new planning applications for major developments from 12 February 2024.   Major developments include residential developments with 10 or more dwellings, or where the site is greater than 0.5 hectares. 

Transitional arrangements apply so that BNG will not apply to planning permissions where the planning application was made before 12 February 2024.  The transitional arrangements also provide that where a planning application was made, or planning permission was granted, for a development before 12 February 2024,  BNG will not apply to any subsequent planning permission for that development granted on an application made under section 73 of the Town and Country Planning Act 1990.
